I don't believe that the law specificly says that they cannot activate
older phones. As far as I know, it requires the carriers to ensure that
a certain percentage of phones are E911 enabled, either by use of GPS,
or by network based technology, enabling the location of the phone to
within a certain number of feet. It also requires that all new activations
after a certain date to be E911 enabled, which appears to be interpreted
as new phones sold by the carrier thru it's distributors.
