Would it be considered a privacy violation to send someone a text
message on behalf of someone who provided the cell phone number? I
have a web site which will do this. A user can enter a phone number
and check a disclaimer box. The disclaimer check box states they are
authorizing us to send the text message and that the recieving party
may be subject to charges.

Thanks,
Richard.

Privacy would be just one of the problems I would be worried about.

Run this past a decent liability lawyer to find out what your company could
be charged with for accepting authorization from a 3rd party that authorizes
charges to be made with out the express permission of the party paying the
bills.

You may also run into problems with people initiating harassment or SPAM
messages to people listed on the Federal or State Do not Call lists.
