No one knows except them and they don't specify the threshold at which
you go past the acceptable use policy. Unless you're still one of the
few running a file-sharing platform like BitTorrent, I'm not sure how
you could be coming upon those issues. They only care if you're doing
a large amount of uploading, as a rule.
As far as your last question, it's the total bandwidth you use, not
your speed, which you can't control anyway.
